Kyle Rittenhouse Trial
Weighing in on criminal trials can be tricky business. Especially if you haven’t seen every minute of the proceedings.
Yet, after a solid afternoon of watching the testimony of Kyle Rittenhouse who’s on trial in Kenosha, Wisconsin for shooting three men and killing two during the riots of August 2020, it’s clear that Rittenhouse may be guilty of several things: poor judgment, of being where he should not have been and of possessing a gun he wasn’t old enough to own.
But he isn’t guilty of homicide.
His own testimony about what went down during the chaos in the Kenosha streets on August 25, 2020 was compelling and combined with video, confirms that he feared for his life and acted out of self defense when he opened fire.
In fact, the man he wounded - a witness for the prosecution - testified under oath that Rittenhouse didn’t shoot him until he pointed his own Glock at the then-17 year-old kid’s head.
Classic self-defense.
The kid acquitted himself well on the stand, too.
Beyond that, the outrageous behavior of prosecutor Thomas Binger who seems to be trying to provoke a mistrial by deliberately bringing in issues Judge Bruce Schroeder excluded from the trial, indicates that even the state believes it is not going to get a guilty verdict.
Looks like Binger wants a do-over.
Schroeder was clearly irritated with the prosecutor yesterday, angrily scolding him and saying he didn’t believe Binger’s claims that he was acting in good faith.
“Don’t get brazen with me,” he snapped at Binger at one point in yesterday’s trial.
It’s difficult to understand why the homicide charges were ever lodged against Rittenhouse, except that the explosive mood in Kenosha demanded vengeance for the shootings.
After watching yesterday’s riveting courtroom action I flipped around cable news to see how the lefties were spinning it.
I was pleasantly surprised to hear CNN talking heads admit that Rittenhouse probably isn’t guilty of the more serious crimes of homicide with which he is charged.
Then I was shocked to see Jeffrey Toobin - CNN’s legal expert who was caught, um, playing with his man-thing during a Zoom meeting with colleagues in October 2020 - weighing in on the case.
I can barely look at this Harvard-educated masturbator anymore.
Toobin was sacked from The New Yorker for his indecent behavior. CNN was more forgiving. They suspended Toobin until a few months ago.
You would think getting caught with your pants down DURING A BUSINESS MEETING would be a humbling experience. But no, Toobin is as arrogant as ever.
"What kind of idiot 17-year-old gets a giant gun and goes to a riot? He has no license, he has no training, he thinks he's going to scrub graffiti off with his AR-15? I mean, the stupidity of this. What could possibly go wrong? Well a lot went wrong," Toobin said. "The good news for Kyle Rittenhouse is that he's not on trial for being an idiot, he's on trial for homicide."
‘This is a tough case for the prosecution because it does seem like he has a plausible case of self defense," Toobin added. "If it were illegal to be an idiot the jails would be even more crowded than they are now.
Careful there, Mr. Toobin. Few things in life are more idiotic than playing with yourself in front of your co-workers. In fact, in some jurisdictions exposing yourself in the repulsive manner you did might also be a crime.
Then again, maybe Toobin is right, maybe Rittenhouse is an idiot.
If so, it takes one to know one.
